renewal of EAD of the spouse of asylum applicant
I filed for asylum two years before. I included my wife in the application We applied EAD in April 2001 and we got for both of us. Since then, we have been working. I have always been in F1-student status as well taking full time courses to date.
We applied for the renewal of EAD (form I-765) in April 20, which is some 70 days before the expiration. I got the notice of receipt (Notice of Action Form I-797c) within two weeks. But my wife has not received the receipt notice yet. 55 days have passed since we filed for the renewal. We have the US postal certification that her application has reached the INS Texas Service Center. She attached the followings in the renewal request of EAD (I-765):
(1) the signature card (with signature but forgot the fingerprint) (2) acknowledgement of receipt of asylum application and pending (which mentions only my name, not my wife’s) (3) copy of her current EAD (4) I –94 (which mentions her in F2 status and D/S) (5) money order of $120.
We are concerned whether they are not going to renew her EAD because:
(1) we filed for renewal in less than 90 days of expiration
(2) there is no print in the signature card (there is only the signature)
(3) there is a mistake in her date of birth in I-94 by one month. But in her current EAD and asylum application, there is he correct date of birth.
(4) I filled out the firm and she just put the signature. I did not mention that it was in my help. I thought it would not be a problem if it is done by the husband.
(5) Or if there is any change in the INS’s approach in this regard
So, what may be the reason behind non response of the INS ? What should we do?

Shouldn't be a problem.
>(3) there is no print in the signature card (there is only the signature)
The print isn't used at the service centers, only for EADs issued at local offices.
For that matter, as far as I know, Texas does not use the signature card at all (I
believe only California does).

Shouldn't be a big deal.

That's a good assumption.

Probably INS lost it. The first thing to do is to find out if INS cashed the money
order. Unfortunately, that's trickier than with a personal check; you should contact
the place where you bought the money order. If they did not cash it, the application
got lost in the mailroom.
The second thing to do is to call the service center and ask. You'll have to call
during business hours and keep redialing for several hours, and then spend another
hour or so on hold before you can talk to a human.

On 5/21/02 I saw a notice that the INS California Service Center no longer requires
the "signature card" to be filed with Form I-765.
