For the I-130 application do need to send in photo copies of your birth certificate and marriage certificate or do they have to be certified copies.

Check the instructions - I-129F which I'm using specifically states when a
copy is allowable.

We just sent in photocopies of both and they approved the petition. It says on the instuctuions that they are no longer requiring originals and that they accept photocopies.

This is what it says in my package:

"Submit the original, or certified copy, of the birth record of each family
member."

"Married applicants must submit an original marriage certificate, or a
certified copy, bearing the appropriate seal or stamp of the issuing
authority."


I wouldn't mess around. Send originals.

I downloaded the I130 from the INS website which comes complete with four pages of instructions. However, nowhere do I see any reference to the non US spouse providing a copy of a birth cert. Could anyone tell me where this is requested?

Hi:

Generally speaking you will not have an orginal -- that is on file with the recording agency. However, you will have an original certified copy.

My practice is to submit a photocopy of the original certified copy. That is allowed under the regulations. However, if INS wishes to see the original certifed copy, then they can request it [this usually happens in adjustment interviews.]

If you want, submit BOTH the photocopy and the original certified copy with a yellow "Post-it" saying "Please compare this with copy and return to me. Thank you." INS just might comply with the request. However, assume that any originals submitted to INS with a petition will stay in the INS file.

Send originals to INS and you will probably never see them again

Send copies. They will be accepted.

never send an original document to INS if you want to see it again!
photo copies are acceptable for an I-130. INS used to require original
documents with the intent of returning them, however, (presumably because
they don't have the time to send stuff back) they will now accept normal
photocopies with submissions and ask to see originals at interview time.

for the record, I sent in photocopies of everything I submitted and kept all
my originals (including the petitions themselves, though I did send in the
"originals" of the signature pages). I included a signed statement that
said "all copies submitted are true copies and the original documents will
be provided for viewing at the time of interview"; then brought all my
originals with me for my interview.

My package had a small white sheet entitled "IMPORTANT DOCUMENT INFORMATION" stating that photocopies are now accepted. Both sides of the document are required.

It states that the originals may be required at a later date.

It is then required to sign the note and submit it with the application.

The reverse side of this note is the Fees List.

Argh!!! I wish they inclued that note with my paperwork. I would have sent

It is over and done. Sometimes ordering the forms by mail gives you more information and instructions than when you d/l from the net or when you do the online completion at the "pay for it" sites.

Bring copies of the originals to the interview and ask to exchange them for the originals.
