Non Immigrant Gun Law (Florida)
I am a big gun fan (mostly range shooting not hunting) Does anyone know the difinative answer on non green card holder purchasing their own firearms?
I believe that ATF say you only need to be resident in the state for 90 days before acquiring a firearm, but gun shop owners say you need a green card? Thoughts? |

I would think there is a distinction between handguns, and other types of firearm. In my state a GC holder can have all but handguns.

Most gun shop owners know the law backwards. What is the State law. Look it up or ask your local Sheriffs Office.

No can do - in FL at least. Must have a green card, even for a shot-gun.

You can certainly get a handgun with a GC where I am.
I thought that was the norm. |

It varies from state to state. Even from county to county.

However you can buy a blackpowder weapon. ie Pieta Remington 1858 or Pieta Colt 1851 or some other similiar blackpowder weapon as they are not considered fire arms in Florida. You can then buy what is called a conversion cylinder and remove the black powder cylinder from the revolver. The conversion cylinder is then fitted and lets you use long colt 45 cartridges in the revolver. The conversion cylinders just drop straight in without any modification at all. It takes approx 20 seconds to change out the cylinders in my Pietta 1858s You can have the revolver and conversion cylinder and ammunition shipped to your door as not considered a firearm. When I got my first one Fedex left the revolver,conversion cylinder and 500 rounds of ammunition sat in the doorway as I was out when it was deliverd. You have just got to love America Look at www.Midwayusa.com under black powder weapons and also conversion cylinders. I own three black powder revolvers fitted with conversion cylinders and they are really nice weapons.They are not toys and are deadly just ask Wild Bill or any of the other famous cowboys from the 1850s Mind you I also have a lot of other firearms and prefer my AR15 M4 Lancaster AK47, Glock26 and other modern weapons better, but it is amazing how much damage a colt 45 bullet from a Remington 1858 can do and they are fun and accurate to shot at the range Regards Alan |

Any dealer who tells you otherwise has never read the instructions on the 4473. http://www.thundertek.net/documents/4473.pdf Supposedly you can get a waiver from the DoJ in lieu of a hunting licence but forget it, they are impossible to get. You also need a hunting licence in order to borrow a firearm at a rental range, some ranges ask, some don't, but the burden is on you. In Florida you must be a US citizen or LPR to get a concealed weapon permit, but not to buy a gun. Ch. 790 F.S. Florida has a waiting period for handguns, three or five business days, depending on county laws and you must meet the federal requirements as well, such as being at least 21 to buy a handgun. The 90 day requirement rules out anyone on the VWP buying a gun, also hard in FL to get State ID, they're pretty tough on implementing Real ID. |

There are States that have various restrictions on aliens possessing or acquiring firearms, Florida isn't one of them other than the change they made a few years ago to limit carry permits to US citizens and LPRs.

I have purchased approx 12 firearms from sellers in Florida and they will not even look at you if you dont have a greencard. I once even got refused on the background check for no apparent reason which took 4 months to sort out with the Florida FDLE but that is another story altogether Regards Alan |
