Default I-94w Tourist Visa

I`m on a six month tourist visa, I was suppose to travel back to Europe sometime ago, but decided to stay. I don`t have a visa at present time and my tourist visa long expired. Will I be in troublewhen I leave the country, when I hand in the green tourist card? Or are they more concerned with whats coming in rather than leaving. I want to go home but fear being banned from the states. What is likely to happen. Please help

Huh ? A Green tourist card ? That's the I-94W used for visa waiver
entry. You didn't even use a visa if that's the case. This permits you
90 days in the US - not 6 months. You long overstayed the 6 months ?
If the date of your entry is more than 270 days ago, you are now barred
from entering the US for 3 years. Overstaying the I-94W means you must
in the future apply for a visa.

You are in deep dung.

You'll have no problems leaving, but don't attempt to come back knowing
that you've overstayed without getting a visa (which you're unlikely to
get unless you can show extremely strong ties to your home country), and
if you're subject to a bar, don't even think about getting attempting to
enter the US until the 3 years is up or else face a lifetime bar.

At last Bossman,
(and i don't want to make light of your situation) but i have found someone that made the same mistake as me. I overstayed by, oh a year or so now and if i hadnt married my wife (a USC) then i'd be in trouble too.
Now i believe (i'm not 100%) 180 days over your visa is 3 year ban and 365 days over is a 10 year ban. Now i know that no-one on the plane tells you about this and you might just think that you can leave when you want and no-one will know, apparently they do. So, (and i don't advice or condone illegal working) BUT if your working at the moment and or a rich enough to just chill then you could stay. If your over your over and thats it. MAYBE if you left they just would never find out (they rarley ask for your I-94 when you leave) but if you've paid for a flight and then get sent back next time you might be pissed. Rest assured though that by being an overstayer your NOT a criminal, not until you overstay a Deportation notice (which unless you gave the adress that your staying at you'l never know). Anyway, if you have a girlfriend here and are not in a rush to leave then you could stay and maybe get married later. Otherwise book a flight back to blighty and get ready for lots of summer hols to magaluf.
Or you could just visit Canada, which i find to be a much more sophisticated place with a higher intelect.
Sorry about you situation mate, hope you sort it.
peace
