Hi all

We wish to have are wedding within hot sunny Jamaica but we have a questions for you all

I an English citizen wishing to marry a US citizen

1) I wish to enter the usa after getting married, can this be done while the filing is being processed
2) Should the filling started be before or after we get married
3) Is there nay issues that we should be aware of for getting married in JA

Generally a pretty bad idea.

If you marry in Jamaica, you can't file for/use the K-1 fiance visa. You must apply
for a spousal visa, which can take > 1 year, but you can't even apply for that
until AFTER you get married. And you can't even apply for a K-3 to visit in the
mean time because that requires that you married in the country you are applying
from (i.e. England).

The K-3 does NOT require you get married in the country you are filing from. Where
did you see this rule? As long as you are married and have filed the I-130, why would
it matter where you married when you want to file the I-129F for the K-3?

foreign state in which the marriage occurred, if the marriage occurred outside of the
United States. This rule provides an exception when the United States does not have a
visa issuing post in that state. "

I read this in page 42587 of the federal Register I will let you find the link.

You can get a K if you are already married..though after reading the law I am not
sure whether it would be a k3 or k1. check out this site:

It details a law change that was done last year to deal with the excrutiating time
lapse involved in the marriage visa process. Excerpted...in other words..straight to
the good part:

"(a) IN GENERAL- Section 101(a)(15)(K) of the Immigration and Nationality

Act (8 U.S.C. 1101(a)(15)(K)) is amended to read as follows:

`(K) subject to subsections (d) and (p) of section 214, an alien who--

`(i) is the fiancee or fiance of a citizen of the United States and who
seeks to enter the United States solely to conclude a valid marriage
with the petitioner within ninety days after admission;

`(ii) has concluded a valid marriage with a citizen of the United States
who is the petitioner, is the beneficiary of a petition to accord a
status under section 201(b)(2)(A)(i) that was filed under section 204 by
the petitioner, and seeks to enter the United States to await the
approval of such petition and the availability to the alien of an
immigrant visa; or"

My attorney told me about this when we were discussing options. You might want to use
the services of a lawyer to at least advise you as to what your options are.

K3 if married K1 is a fiance visa K2 is a child of a fiance visa holder K4 is a child
of a K3 visa holder

A little more on my last post...after rereading the law and deciding it is not meant
for mere mortals to understand. A visit to a lawyer might be a good idea, if only
just to translate this paragraph:
(2) In the case of an alien seeking admission under section
2(a)(1)(A)(i) who concluded a marriage with a citizen of the United States outside
the United States, the alien shall be considered inadmissible under
section 212(a)(7)(B) if the alien is not at the time of application for
admission in possession of a valid nonimmigrant visa issued by a
consular officer in the foreign state in which the marriage was
concluded. ....whatever that means..... My interpretation (not a
lawyer, and semifluent in legalese) is that it can be gotten, but you
really need to be careful to do it right...did I mention that you might
want to ask an attorney?

Thanks to everybody who has contributed to this topic ,so at a guess it will not be a good idea to get married outside the USA
it would make matters worse for the paper work.

If you have any more suggestions please throw them in, as it would be much appreciated.

No sh*t! Well, that makes all three of my company's local telephone providers
officially under bankruptcy protection. So much for designing redundancy. Boy, can I
pick them or what? Heh heh, and I thought they weren't returning my calls yesterday
for the "usual" reasons!

Wow, thanks otter, it sounded too stupid to be true. Why in the world do they care
where the marriage takes plac?. What idiots made this law??... Oh wait... The goal
was to aid one specific country, Mexico, not everyone... So, if your spouse is in
Iraq, then you can get a K-3 if you married in Jamaica, but if you are getting the
visa in the UK, the marriage must take place in the UK.... But, if you married in the
US, you can get the K-3, no matter where you live.... LOL
