Honours Student Loans
 
Hi - I have a few of the old mortgage style loans from pre-98 or so. I am in permanent dispute with Honours student loans about how much etc. Bottom-line: They cannot provide any adequate paperwork, records (different amounts, they keep changing how much) and so on (and lack ability to arrange the booze-up in the brewery). I am sick of them and have long since stopped paying and told them no more $$$ until I get adequate paperwork and explanations. Is there anything they can do about this? I don't live in the UK so they can't get a CCJ right? What else can they do? They keep threatening me but have yet to bite.

Wrong... they most certainly can get a CCJ. Further, it's possible for them to get a US court to uphold their decision.

What's your risk/reward tolerance? Will they bite? Who knows. Can they bite? Yes.

So as far as I know you have to be resident in the UK for them to serve you with a CCJ. Also depending on the wording on the agreement i.e. if it is subject to british credit laws then it might not hold up in a US court.

Obviously route 1 is the pay the debt.... route 2 is to get a good lawyer if they come after you! ;)

They cannot get a ccj if you are no longer resident in the UK. They may try to do so, but it will be set aside.

Can they sue you in the US? Yes. I don't think govt student loans have a statute.

We have had members who have posted that their elderley parent's have received a visit in a bid to recover debts. Something to think about if you have aged parents still in the UK.
