Filing info. any help is appriciated ...!
Hi,
me and my wife(USC) are finally ready to file the pappers for my visa status change,we have gathered the info. from various places , would deeply appriciate if someone can help us to make sure we are on right track.
background
----------
- I came to US on my H1 B1 in 04/2000 , visa is valid till 10/2002.
- Got laid off in 04/2001.
- We got married 10/2001.
forms:
-----
My wife (USC) have to file : I-130
I have to file : I-485 , G-325A , I-864 , I-693 , I-765
* Does the period between my lay off and marriage will affect the processings?
* Do i have to file "I-485 Sup A" too with a fee of $1000 ?
Are we guys on right track ?
Are we missing something ?
Is there anyting more we have to do , which might make the processing better ?
ANY help / suggestions are deeply appriciated .
Thanx

No problem. I would recommend not requesting advance parole, and not travelling
outside the US.

No. This is only for people who file using 245(i). You are using 245(a). You need
neither the Sup A nor the extra fee.

Sounds like it.

I think both of you have to file the G-325A. Also, it might be a good idea to hire
an attorney to handle the details. It's not rocket science, but it's not a bad
idea anyway.

For an excellient concise overview of the forms/document required to adjust your
status, go to:
http://www.geo-
cities.com/immigration_helpsite/I-130/inside.htm
One point to note is that you AND your wife have to submit four (4) copies EACH of
the G-325a biographic info forms.
If you are married to a USC then unauthorized overstay/employment/etc. is generally
forgiven PROVIDED you entered legally and were inpected at your POE.
As I understand it, the "I-485 Sup A" is only required if you entered the USA without
inspection (i.e. illegally). Since you entered on a H1B, there is no need to file the
Suppliment. However, I read somewhere that its safe to file the "I-485 Sup A" just in
case, but don't submit the $1000 Fee.
Good Luck.
