Emergency Flight to the USA - advice please
 
I am sorry to ask my question this way but I I do not know how to start a new thread. I am a dual citizen UK/USA
I had some disturbing news yesterday from my daughter in the USA. my son in law may not make it too many more months so very soon I may have to fly back to the states on a compassionate basis. Due to this COVID situation I have no idea where to start, what to do and what I need when I go. I just wondered if you could help me as I saw that you had come back from the USA. I don’t mind if you private message me or just do it through the forum any help would be appreciated thank you. I have one last question my partner who is a British citizen would he be able to go with me for compassionate reasons. Is there someone I could write to to find out?

I do not see an issue at the US end, well Covid test, more an issue meeting UK travel restrictions.

Partner +=Spouse or friend? Friend would need to quarantine for 2 weeks in Mexico wherever.

I believe as a US Citizen you should have no difficulty in returning to your own country (US). Use your US Passport booking your ticket and entering the US.

Make note in advance of the restrictions, if any, in regards to quarantine after entry.

As others have mentioned, you could literally buy a plane ticket for tomorrow, get tested today with antigen (same-day test result), and fly out tomorrow.

As Boiler mentioned, it is your partner who's an issue. If you're not married, he doesn't automatically qualify to enter the US. You have two options: file for a NIE (they just tightened who qualifies, so this may be a long shot), or as Boiler mentioned, he could fly separately to Mexico, stay there for 2 weeks, and then enter on ESTA to the US.

One word of advice on ESTA-- your husband should check if he still got a valid ESTA (it's issued for two years). If not, do not apply while in the UK. Apply while in Mexico, and do not check in for the Mexico to US flight online, it must be done at the check-in counter in person (or else the ESTA may get revoked automatically).

If you are hoping to leave the UK before May 17 you will also need to complete an international travel declaration. You will “self-certify” that you are traveling for a legally permitted reason (it would be reason number 4, in your case, for medical and compassionate grounds). Whether that would cover your partner’s 14-day stay in Mexico or wherever he quarantines, is debatable.

I just wish there was a waiver I could get for my partner but I don’t know who I should contact about it. I will be glad when Joe Biden opens the USA up again so things would not be so difficult for us. Someone was talking about A national interest consideration. What is that and do you think I should try enquiring for my partner? Thank you in advance.

As I said in my earlier post, it’s a long shot but given that this is a medical/compassionate emergency and the British partner in question is married to a US citizen, it’s worth a shot.

I would not put NIE in the same boat as the UK’s “declaration form for international travel”. Additionally, if someone secures an NIE for US-bound, clearly they are no tourists and so should be no concern for the airline or police (as long as a valid reason is declared on said form).

Correction: "the British partner in question is the partner of a US citizen". Of course, no NIE would be required if they were married.
