Driver's License renewal for H1-B

Default Driver's License renewal for H1-B

I am in US on H1-B. My Driver's License is up for renewal. I was told
that after 9/11 laws only citizens and green card holders could renew
the license. Is that true? Can an
H1-B person do it? If so what papers are required for renewal?

Send in the fee and they might automatically renew. You are
better off contacting your state drivers license bureau and
asking about it.

And if the DMV messes you around then contact your state representative
and congressperson because the rules and laws they are promulgating end
up in direct conflict with each other.

I have an O-1 visa and did not have a problem.

Not true. The rules have been tightened, but are far less restrictive than
what you propose. Generally, it should be possible to get a DL for anybody
with work authorization. There still are groups of people who often cannot
get a driver's license but should be able to (this is subject to state
law, so things may be different depending on where you are). For instance,
spouses of H-1Bs (in H-4 status) cannot work and are expected to remain at
home without driving for up to six years.

It is even easier with renewals, since for the most part the immigration
status is only checked when the DL is first issued.

driver's license.

The regulations vary from state to state. For instance, Pennsylvania passed
legislation in December 2002 to the effect that foreign nationals would be
clearly identified on licenses (expect more of this type of legislation in
the future). As of this writing, I do not believe the regulation has been
implemented (as in actual stamping of licences).

Other states are adopting similar approaches. Here is an example:

I am on a TN visa from Canada. After the initial five pieces of I.D. were
submitted (paystub, lease info, utility bill, SSN and passport) I received
my license. Because a TN is still relatively novel to bureaucrats below the
federal level you might have to insist on seeing a supervisor who
understands the details of a TN (or other visa) application. But insist
nicely ;-)

A H1-B or H4 person can renew the Driver's License. I did it 2 weeks
ago online for Virginia. I didn't need any papers only 20$.

Since drivers licenses are issued on a per state basis, and if you'd
read, you'd realize that people in some states are being refused in some
states. Just because you can do it in Virginia does not mean everyone
can do it everywhere.

They can probably just try a different office of the DMV.

Again, there have been laws passed in some states that make it
impossible for people on work visas to get US drivers licenses/renewals
while another part of the law makes it illegal to drive if they don't.

In some states the DMV has issued regulations that similarly make it
impossible.

Going to a different office is simply a case of hoping that you get
someone ignorant of the new regulations or laws. I wouldn't count on
it. It's usually the long standing regulations and laws they forget!
