Unhappy Couple of questions

Hi,

My brother got married to a US citizen in 09.2001 and has now got a GC. If he wanted to sponsor me I believe he needs to be a citizen also. How long does this take?

Also I have two kids 4.5 and 2.5 and know that sponsoring brothers and sisters takes about 12 years at the moment and is likley to increase as time goes by. I was wondering that when and if I get my sponsorship will my kids be included even if they age-out 21+ ... ?

Hi J,

He will be eligible to apply for citizenship in 3 years (2 years and nine months after the date he received his gc). This process takes up to a year depending on the state. He can then sponsor you and yes the process takes about 12 years. He can sponsor you and any of your children under 21, children over 21 will not be sponsored, so if your unlucky and your eldest turns 21 before the interview then they won't be able to come. (unless you sponsor them after you get your citizenship in 7 years of living in the states).
