Default Consular processing pros and cons

Hello ALL,

I wish to go for a consular processing in India. I heard its fast compared to I485.

Can somebody tell me the approximate time it will take for an interview from the date of applying for a CP. Also what are the general questions asked in the interview and if there is a refusal cant we enter USA again ?

I have no experience with India, so I can't really tell you times. In most cases,
consular interviews are extremely short, basically just "congratulations, here is
your visa". That is because all the important work has already been done. I would
expect a security check, though, given the current world situation.

If the visa is denied, you may or may not be able to enter the US - it depends on why
it would be denied. Sometimes, there might be a paperwork mistake, say, you left your
birth certificate at home in the US. In such cases, the consulate would typically
give you a tourist visa in order to retrieve the document and come back.

If the immigrant visa is denied for something like a criminal history, there will be
little chance you could ever enter the US again.

Keep in mind that immigrant visa denials are much rarer than non-immigrant visa
denials, as long as the paperwork is in order.

I agree with Ingo...but lately they have started asking for some extra formalities to
be done for CP. One thing is that they are asking for Police Clearance Certificate
(PCC) from Indian Consulates in US (if you are already in US) or Passport Office and
Local Police in India.

What do you mean by "applying for a CP"?

Here is a typical timeline for an employment-based consular processing case.

First, let's assume that an I-140 was filed, and CP was requested on the I-140. It
does not matter what category the I-140 requested, whether labor certification was
required, or how long the I-140 takes from filing to approval. You will have to
figure these out for your own case.

From the date of approval of the I-140 to your receiving
Packet 3 (or its successor) from the National Visa Center:

2 to 3 months.

From your sending out the Packet 3 reply to your receiving
Packet 4 (which notifies you of the interview appointment):

2 to 3 months.

From your receiving Packet 4 to the interview date:

2 to 4 weeks. (Sometimes Packet 4 does not arrive before the interview itself; you
have to keep calling the consulate to find out when the interview appointment has
been scheduled.)

You get an immigrant visa at the interview (or within the next few days), and you can
enter the U.S., and become a permanent resident at entry, any time between the same
day (of receiving the immigrant visa) to six months later.

The websites have good information about this. Generally, employment-based immigrant
visas are rarely refused. You would never get that far unless you had a good case.
The consulate has the power to cancel your nonimmigrant visa, but it would be quite a
rare occurrence, I believe, for the consulate to do that when it has not issued the
immigrant visa.

The questions are something like: "So, what do you do?" "Is this your current
address?"
