Can't Get Drivers License!!!

My wife (been married 1 year and waiting AOS) went to get her license and was told K1
visa are not accepted and can't even take the test. Can not get a drivers license
until she gets green card. We were told that most states were changing to this.
Anyone having this problem in other states?
Have called everyone at DMV including headquarters and was told the same - just
changed ruleslast week.

Which state? Contact your state representatives - sounds like they are just

My husband never had a drivers license when we married, he was from Canada and had NO
problem what so ever getting a drivers license here in Kansas!

Question
After a year of marriage, she is only now going for her driver's license? Does she have an EAD? A social security number? Have you asked if the presentation of a current EAD card which serves as proof of pending and the receipt for the AOS issued by INS is good enough for the issuance of a driver's license?
I can understand the denial of a driver's license with the K-1 only. Let's face it the K-1 is a "non" immigration visa. If you don't marry the petitioner and file for AOS you have to leave the country. With the issuance of driver's licenses to every Tom, Dick and Harriet (remember the posts re how you can get a Texas license without any visa whatsoever) and the attack on 9/11, it is no wonder that something like this has been instituted.
When you call your congressperson, see if the issuance of an AOS pending letter from INS would do the trick. He/she might be able to have the congressional interest department at the INS office give you such a document.

I received my Oklahoma drivers license without a written or driving test. I only had
my K-1 visa, no social security number.
I crossed into the US on Sept 30, 2001 and received my license on October 9, 2001.
Not a problem at all.

Dear JE,
When you apply for a document from the government, you are given a form to fill up.
Also, you must show proof of identity.
Did she fill out all the fields in her form? If some of them are empty, for example a
social security number, she can apply for it and then re-apply for the license.
Did she show all that is required to prove her identity? The accepted forms of
identity should be and usually are posted on the wall.
If there is an additional new requirement, like showing a green card, it should be
posted on the wall at the DMV. If it is posted there, You might want to check whether
it is hand written (might imply that the new requirement is illegal) or on a form
with a form number.
If all requirements are met, they usually don't ask questions and just start
processing.

This just sucks big time.... what are we all supposed to do until our green cards are
issued ?? total overreaction, i cant imagine too many of the perpetrators of sept
11th enetered on k1 visas.. it just makes me wonder what happens next?? no SSN ??
Im gonna be entering the states (Arizona) sometime December (well, as long as my
interview goes ok... ) , and if i cant drive i am going to be majorly pissed off.....
apart from the impact on job-hunting etc etc

I was told over the phone initially that yes I would have to take both the written
and the driving test, but when I got there (prepared to do both tests of course) the
lady spent about 30 minutes on the phone verifying something about my Canadian
license she then called me in and gave me the paperwork to take to the tag agency to
pick up my license.
For anyone else going through this in Oklahoma I used the following offices to get
my license:
Testing Center Claremore, OK Tag Agency Catoosa, OK
The tag agency was initially quite a bit concerned that I did not have a SSN, but
they again called someone and verified that it was OK for me to get a license
without a SSN.

Do Your State Homework Before You Jump Off the Deep End
I may be off base here but I think you all are missing the point. I've posted the point system from the NYS DVM below. One of the required documents is an UNexpired I-94. As this woman has an obviously expired I-94 she cannot get a license in NYS unless she had an EAD Card or a travel documents. Now this is NYS, don't know if it is the same for her state or anyone else's state. If you are going to be needing a driver's license and you are coming here on a K-1 or even marrying from a tourist visa, check out the state you will be living in and if an unexpired I-94 is all that is required ... then get your license asap.
Here are requirements, or the point system, that you have to fulfill in order to qualify for a driver's license. One of those is proof of age. This is shown with either a bc or a passport. Both of these items show that you were not born in the US and in that instance, the DMV might well ask for proof of your having been examined upon entry into the US. Below is a list from the NYS DVM and you will note what they ask for to validate your being here in the US.
The following documents have a value of 6 points each:
New York State Photo Driver License/Permit/Non-Driver ID Card.

Holy shit! Are you trying to say once I enter the US I can't get a drivers license until I get a Green Card!!! How is anyone going to get around, or get a job????
