the basics... we won.
Andrew (jackies ex) gave up today after he was served with a second notice. He first tried to get us to agree to having the case handled in texas... then he called jackie and said... I give up.. he didn't want the financial drain on both sides. Essentially he's agreed to a 9/3 share.. but jackie wants the current contract to be played out first... so we're back to 2months sharing until Drew hits school when 9/3 share with us will come into affect. We will have the kids for the school year, he'll have them for summer and every second holiday. We are currently waiting for our lawyer to draw up the papers and then a paper trail between us and Andrew begins... we hope to have the kids back by saturday and be home sunday. Even now Andrew doesn't know we're actually in the area so we can pick the kids up in person asap. thanks for all the advice and comfort along the way Andy & Jackie |

Dude, I would get the F out of this relationship if I were you. plain and simple.
I personally would have NEVER let her move in. Did you know about all this before she moved in? |

You were certainly candid, but .... maybe a PM might have been better? *Every* case involving children under joint custody orders is going to be complicated. As someone in that situation I accept that. *Every* potential spouse brings with them unique limitations and drawbacks as well as unique joys and capacities. My concern was that Texas NOT be the jurisdiction of the case because a) it isn't the legal domicile of the children and b) Texas courts are very biased and the judge has almost complete discretion to order anything. And you can't appeal it. |

today he signed the papers - jackie picks up the kids tomorrow. In the end it seems advice from his lawyer was the chief factor in his intial decision to try to get FULL exclusive custody - his lawyer was fired this morning. I'm sure we'll get more information at a later date but thats it for now.

the saga continues
after letting jackie book the tickets to go get the kids (having agreed time, place etc) ... he emails us saying he's not handing them over until the judge has signed the paperwork and he has copies of it all in ORIGINAL form in his hand... oh.. and I forgot to mention he never actually posted his originals (fancy that eh?) we have a faxed copy. Our lawyer is on it and has tried to explain to him and his lawyer (we're not sure on the status of his lawyer) that once he signed the document prepared by our lawyer he is bound by law to abide by that document and it IS actionable in a court. He hasn't replied yet, I told jackie to fly down regardless and hopefully he will realise his mistake ... if he doesn't then she's going to stick around until we get it sorted out. Right now I'm pretty sure he's just worried - not with any actual grounds mind - just worried. I don't think he understands the legal process involved and his (ex) lawyer doesn't seem to be helping out much. just an update really - we'll get them back in the end... it just might take a little while longer and a little more money |

we have them back now - jackie is on a flight from austin tonight and will be back late on.
