wife coming to US: tourist visa/H-4 visa?

Default wife coming to US: tourist visa/H-4 visa?

I'm on an H-1B in the US, and my wife lives near Toronto (Indian citizen,
landed immigrant in Canada). We got married a few weeks ago in India, and we
have a marriage certificate from the local authorities.

What should we do wrt a visa for her? She already has a multiple entry, long
validity tourist visa. All appointments in Toronto are taken for the next 10
weeks, meaning she won't be able to come live with me for 2+ months if she
waits for an H-4 visa.

Can she come live with me on the tourist visa, and get it changed to H-4 as
and when appointments become available?

That's an interesting question. I would recommend that she return to
Toronto to apply for her H-4 after visiting you.

She is not allowed to use a tourist visa with the intent to change to
another status in the USA. But visiting will probably not be a problem.
At worst, she will be denied admission, which shouldn't have any
negative immigration consequences.

Turns out she got an appointment at the Toronto consulate, so we're just
going to wait until she gets an H-4.

Another question I have is: will a marriage certificate from India be
accepted by the consulate in Toronto? Has anyone been in this situation
before?

Generally, any valid marriage certificate will be accepted, regardless
of country (as long as it is for a marriage that would be valid in the
USA - no polygamy, the partners must be of opposite gender and old enough).

If the certificate is not in English or the language of the location
where the consulate is, you will also need a translation.
