While filing for status change I 539 - does one has to indicate prior filing of immigration petition
Hi I was planning to attend school in Fall - and intended to file for a status
change. My I140 has not been approved as yet and in all probability, I will have to
discontinue that. When I file for a status change, does the fact that I have filed
for I140 become an issue. I understand that this is an issue while applying for F-1

Possibly, especially with INS new policies and security concerns surrounding
students. I would attach a note explicitly stating that even though an I-140 is
pending, you no longer plan to pursue permanent residency - that should take
care of that.
