what type of visa and how to apply

Hi, I am a Nigerian of adult age and a graduate of accounting, I am wishing to stay in the
US and settle down after a little while with my fiancee.

I am in a fix as to how to go about applying for the visa and how long it might take my
would-be-mother-in-law has a house and her own business in the state and she is willing
that i stay with her until i can manage on my own.

please assist me and reply thru the newsgroup, thanks for your help.

If your fiance is a US citizen, all you have to do is to marry and file for adjustment of

Please excuse me, if you are NOT in the US at this time, your US fiance would need to
apply for a k-1 visa for you: http://www2.apex.net/users/thehydes/k-1frames.html

Alvena,

He is in Nigeria, and his fiancee in in Nigeria waiting for some kind of visa which he did
not specify. The fiancee is obviously not a U.S. citizen.

Jubril sent me this and asked for a reply on the newsgroup. Jubril, please reply to the
newsgroup.

"My fiance is waiting on the filling done for her at the US embassy in Nigeria by her step
father who has been in the US for like 30yrs,same thing was done for her mum too and it
has taken like 9months now since they started the processing, the final review is been
done now and they are expected to get their papers by month end(february)."

It sounds as if your fiancee will obtain an immigrant visa as an Immediate Relative, child
of a U.S. citizen, although from the facts given this cannot be known for sure.

I make this guess because of the brief processing time, only 9 months. Other family-based
categories are numerically limited and they have long waiting times for the quota.

This would only be true if your fiancee is under age 21, and the marriage between her step
father and her mother occurred before she reached the age of 18. That way she can meet the
definition of "child" and "immediate relative."

Assuming your fiancee gets an immigrant visa, when she enters the U.S., she will become a
permanent resident, or holder of a green card. As such, she could marry you and file a
family-based immigrant petition on your behalf. However, your category would then be
Family 2A, a numerically limited category with almost a 5 year wait for the quota. During
the wait you would have no special privileges to live or work in the U.S. In fact, the
filing of the petition will work against you if you try to get various temporary visas to
enter the U.S., visas which require that you have temporary intent only.

It seems that you must look into business-based or employment-based temporary visas which
might allow you to enter the U.S. and work, or even perhaps a student visa to allow you to
pursue higher education. It is probably best not to mention your
almost-U.S.-permanent-resident fiancee while trying to get a visa to enter the U.S. See
