Hi,
Please help me with my following situation:
I applied for a K-1 visa for my fiance so that she can join me in the US. She
got an interview date from the US consulate abroad but has not yet gone for
the interview. In the meantime, unfortunately, our relationship has ended (we
broke up). Since she no longer is my fiance, WHAT HAPPENS TO THE EXISTING K-1
VISA PETITION?
Do I need to do anything now regarding the petition? I want to know if I can let
the petition just 'die' or if I need to inform INS about the break-up and have
them close my file.
Thanks very much for any responses.

Send a FAX to the Consulate, along with a copy of the NOA and/or any letter you may
have received from the Consulate with a tracking #, stating that you have broken up,
and no longer intend to marry her.

Mmmmm. Wouldn't this look like mischief from someone who does not like this kid to
marry some foreign -- obviously rotten -- person ? It would be best for the
poster to "let it lapse" -- it would in 4 months anyway. This would also
help the future petitioners; the consulate may not get the notion that they
ought to demand a weekly reiteration of constancy of purpose from those USC
fiancees that they are still in the chase and continue to be interested in
sponsoring the potential interviewee. " Do nothing; Let it die " is not only
better; it is also easier to do.

However, if he files for another fiance visa petition, that first one is going to pop
up and there may be questions asked. I think it would be better to have the
documentation in the file as to what exactly happened. Just MHO, however.

This is a good question. I applied once in 1999 for a K1, but we broke up. I never
replied to the request for more information and the petition was never approved (no
interview scheduled). I just let it expire. I explained that on my new I-129F. I hope
it isn't a problem.
Anybody else have a similiar experience?

I disagree. If the interview has already been scheduled, likely, no more input from
the petitioner is necessary for the alien to obtain a K-1 visa. He should indeed
inform the consulate of the break up of the relationship.

You are right and so is paulgani. However, could the consulate cancel the visa
interview on receiving a note, letter, fax or phone call from someone claiming to be
the USC petitioner and alleging such a break-up?

In either situation, I think that the consulate would be obligated to check and be
sure, however upon so doing, I see no reason why they could not cancel it.
