What is parental consent in the Phil

Default What is parental consent in the Phil

I have met a girl from the Phil that is 19 and just found that she needs
parental consent. in order to marry me.

Does anyone know what that is exactly , and what the process consists of?
She has told me she needs my bio data in order to get this done, sounds
strange to me, but I don't know.
Any information on this would be greatly appreciated.

Art. 61. In case either of the contracting parties is a widowed or divorced
person, the same shall be required to furnish, instead of the baptismal or
birth certificate required in the last preceding article, the death
certificate of the deceased spouse or the decree of the divorce court, as the
case may be. In case the death certificate cannot be found, the party shall
make an affidavit setting forth this circumstance and his or her actual civil
status and the name and the date of the death of the deceased spouse.

In case either or both of the contracting parties, being neither widowed nor
divorced, are less than twenty years of age as regards the male and less than
eighteen years as regards the female, they shall, in addition to the
requirements of the preceding articles, exhibit to the local civil registrar,
the consent to their marriage, of their father, mother or guardian, or
persons having legal charge of them, in the order mentioned. Such consent
shall be in writing, under oath taken with the appearance of the interested
parties before the proper local civil registrar or in the form of an
affidavit made in the presence of two witnesses and attested before any
official authorized by law to administer oaths. (9a)

When you say met, do you mean in person or though the Internet? Before you
do anything regarding getting married or filing any visa petitions, get her
NSO birth certificate to make sure of what her legal name is. NSO is famous
for typos. Will make life easier for you if you use her name on all
documents the way the NSO birth certificate has it.

Thanks much for the information, I think my lady is getting information from
friends that really don't know exactly what to do. Probably heard things
here and there.

I will check out that website, thanks for the url. And take this lawyers
info for further info if I need it.

I like rice as long as it has the right amount of butter in it

Hi All,


On Mag-anak there is always someone going through or just been through the visa
process in Manila, so it's a good source of info and Jeanie Pulido is a very
good lawyer and honest.

I'm not crazy about rice and if you don't say something you will be eating it
24/7. I had to tell my wife that you are going to have to learn to cook
something that doesn't include rice. Of course it has been a bit of trial an
error. Like when she made beef stew and put pineapple in it. It was requested
that item be removed from the menu and to never return. LOL

service and reasonable prices:

Richard, I got this parental consent from my parents. This was during my AOS
because I look very young.Although I have already my passport and
birtcertificate. Your fiancee need to make statement consenting on the
marriage, they must state there name and there relations to the beneficiary.
Then have the lawyer notarized and some witnesses too. This is what my parents
did and it works. Good luck.

But, since she is 19, and the age of consent in that country is 18, she
won't need any legal documents from her parents.

If the bride-to-be is 21 years old or under , she will still be required to present parental consent to be eligible to marry .

I am confused. The law previously posted said 18.
Did it change?

Here's what the Family Code of the Philippines regarding this matter .

Art. 15. Any contracting party between the age of twenty-one and twenty-five shall be obliged to ask their parents or guardian for advice upon the intended marriage. If they do not obtain such advice, or if it be unfavorable, the marriage license shall not be issued till after three months following the completion of the publication of the application therefor. A sworn statement by the contracting parties to the effect that such advice has been sought, together with the written advice given, if any, shall be attached to the application for marriage license. Should the parents or guardian refuse to give any advice, this fact shall be stated in the sworn statement. (62a)

Richard im from the Philippines. Parental consent is a is a signed permission letter from her parents to marry you. If youre going to marry her in Church (here) you will need a lot of requirements like your Birth Ceritificate and have to attend seminar before wedding, and of course You have to get first the Legal Capacity of Marriage to the USEmbassy Manila..
