Default What exactly are the I-94 and I-95?

Hi all,

My husband has received his IR-1 visa and we are making arrangements for our arrival in the US, scheduled for December.

Since we will be new arrivals and cannot demonstrate income or employment, the manager of our apartment complex (we've just applied today) has asked for a photocopy of the visa and also a photocopy of my husband's "I-94/I-95". My understanding of I-94 is that this is the green paper that he used to get when entering the US on the VWP, and that he's not supposed to fill one out when he arrives to start his residency. Is that understanding correct? Will he get anything called an I-94 or I-95 when he activates his visa?

I googled both documents. The I-94 seems to be that green form, and I couldn't get a solid answer for the I-95.

Thanks!

The I-95 is for airline/ship crewmembers. He won't have one of those either. If you're comfortable doing so, give the landlord a copy of the immigrant visa from the passport. Once stamped, the visa is considered to be a green card.

Ok, great, I will give them a copy of the visa. I'm comfortable doing so - I'm very pleased to have found an apartment manager who is willing to let us use savings instead of employment income. We've been searching for someone like that for weeks now.

So he will have neither the I-95 nor the I-94, but will have a stamped visa which is equivalent to a green card. Cool.

The I-94 is white - it gives the date when a visitor must leave the US. The I-94W is green - it's used for the VWP and is valid for 90 days only.

Well... he probably will be asked to complete an I-94... if for no other reason than to make the airline people happy. However, it'll be irrelevant for all practical purposes since his validated immigrant visa will supersede the I-94.

You're right, they do like to do that. Just stuff it in your pocket and throw it out later.

Hi:

I returned from a trip foreign last Wednesday -- the airline crew said that AmCits, Green card and new immigrants need not fill out the I-94 -- I am assuming that the Chinese and English instructions were identical.

Also, although I went through the US Citizen line at LAX, a couple ahead of me presented one US passport and one ROC passport with I-551 card -- so I saw US-VISIT in action. That lady started her inspection 45 seconds before my wife and I did and we cleared immigration first. It didn't strike me that US-VISIT was ready for prime time yet.
