waiver question
As I had earlier written on this page, my husband had once overstayed his vw by 21 days. Thus when he tried to enter the US again, he was turned back.
When they saw that on our application for DCF, they said that we needed to file a waiver. Is it normal that they ask for a waiver for such a short overstay?

Your waiver will be required due to the overstay on your husbands record.
Overstays are considered serious by the INS, while the length of an overstay has an impact on the punishment for such, 21 days or 80 days is still an overstay.

It is normal to have to file a waiver for any overstay at all, even one
day. Bear in mind, this is a legal process, and it operates off of legal
laws. They hold you to the letter of the law, because they have no
choice.
