Default Visa Waiver Program

Hello

I have booked return flights to New York from the UK within the specified 90days in the Visa Waiver Program.

I will not be working or studying whilst in the US, I will however be renting an artist studio for the duration of my stay.

The studio is for my own private use to practice painting while i stay in New York...

Can anyone tell me if this violates or causes any complications with the guidelines set in the Visa Wavier Program?

Your not selling or working ..so no problem there
always book for 88 days ... last minute delay or cancellation
may take you over the 90 days.. just a little less worry

There is one thing I'm confused about regarding the 90 day rule on the VWP

Being a Brit holding a UK Passport, is that a total of 90 days total in any 12 month period or is that 90 days every time I enter the US after returning to the UK.

So for example say I went to the US for 60 days, not working or earning any money, just staying in my holiday home, then returned to the UK for a period of time then went again for 50 days the next time. Is that allowed or have all my trips got to amount to 90 days per year. It's not exactly clear on the US Immigration website to me, they don't state whether it's 90 days per visit as long as you leave the US and go back to the UK or 90 days in total.

It's 90 days per entry. But they can and will turn you around if they think you're living here rather than there. A safe rule of thumb is spend at the very least as much time out as you spend in. As you start to build up a pattern of long stays here, they'll get more and more suspicious unless you have a reason acceptable to them, e.g you're a retired snowbird. Also should note, trips across neighbouring borders don't generally reset the count.

Yep this is true, I spent 88 days here in early 2007, then spent 3 months travelling round South America, and re-entered and New York and got another 90 day stay. I'm not sure what the minimum required time is though for leaving...
