visa expired
Hi,
We sent off the package to Vermont INS for my husbands adjustment of status
in the end of october. We just got the entire package back in the mail
saying we sent an incorrect fee. They now say we have to send it to the NY
city INS instead of vermont, which we are not even in one of the counties
that is covered by the NY city INS's district office.
My husbands visa has now expired the 28th of November. We just send the
package off to the NY City INS as requested to do by Vermont.
What will happen to my husband now his visa is Expired?
Any help would be much appreciated.

Nothing will happen to your husband. He is fine with an expired visa. Why did you send it to Vermont? Do you live in the Baltimore, MD area? Or do you really live in New York State? If you do live in New York State, which county do you live in? There are three NYS INS Offices, NYC, Buffalo and Schneteday/Albany.

we sent it to Vermont, because the the instructions on the AOS form said to.

The Albany Sub Office serves the following counties in New York State: Albany, Broome, Chenango, Clinton, Columbia, Delaware, Essex, Franklin, Fulton, Greene, Hamilton, Herkimer, Madison, Montgomery, Oneida, Otsego, Rensselaer, Saint Lawrence, Saratoga, Schenectady, Schoharie, Tioga, Warren, and Washington. "
If the petitions are returned to you, run, don't walk, to that office and file in person. They accept walk-in filing and are easy to deal with and rather efficient. Your EAD is no longer obtainable on the same day as filing due to new mandates but your husband should receive it within 30 to 60 days from filing. His AOS interview will be in approximately 6 months from filing.
Only wish you had known about the NG before filing. You only file at the service center level if your husband is overseas and you are filing the I-130 at the same time. If the spouse is inside the US you file both at the local level. You don't say if he entered the US on a K-1 Fiancee Visa so I am assuming he was a visitor, you married and are then filing for his adjustment of status and that there is where you got confused. Then Vermont added the wrong ingredients to the pot with the directive to file in NYC.

We mistakenly sent out I-485 to the Texas Service Center instead of
the Dallas INS office and the TSC was nice enough to forward it for
us... after 1 year!!!

It was a big help, and hopefully we will get it fixed as soon as possible.
your right the Albany office is the one we should have sent too.
