Using an immigration attorney question
When using an attorney, will I do all the listed steps below at the same
time and then leave it all to the attorney? Can all those documents be filed
at the same time by the attorney if he has those forms? Apart from better
knowledge of the process, what else will using an attorney bring to the
table?
Input welcome, how many have used attorneys?
Thanks
Patrick
a.. I-130 Petition
a.. I-485 Application To Register Permanent Residence or Adjust Status
a.. I-765 Application for Employment Authorization. You will apply as
category (c)(9), "adjustment applicant". (optional, but you cannot work
without this)
a.. I-864 Affidavit of Support
a.. G-325A Biographic Information
a.. WR-702, WR-703 or I-468 - Data Collection for Alien Documentation,
Identification & Telecommunications System (ADIT). (If you don't get one of
these forms in your package, don't worry about it. These are "office
specific" forms which may not be used at your local office. Check local
procedures by calling 1-800-375-5283)
a.. A copy of form I-94, Nonimmigrant Arrival Departure Record (this was put
in your passport when you arrived)
a.. A copy of the marriage certificate
a.. A copy of your birth certificate. (bring an extra when you move, or two
or three if you can). You need a translated copy if it is not in English.
a.. 2 photos - the 3/4 face view - like you have done before, but more may
required, depending on the requirements of the local office.

Re: Using an immigration attorney question
Do you have a special case? Do you have overstays, criminal convictions, etc?
Are you good with detail and forms?
These are questions to ask.....

Patrick
Depends on the arrangement you make with the attorney.
Depends on the facts of your case, and how knowledgable and experienced the attorney is.

Re: Using an immigration attorney question
meauxna,
I think your context is correct. The OP's list is verbatim from the K1 FAQ (6.2, not 6.3, where I saw it) with 1 exception - he added an I-130 at the top of the list.
A K1 or K3 visa person would not be submitting an I-130 with their AOS package. (OK, maybe some K3s would include an I-130 under a certain circumstance.)

Re: Using an immigration attorney question
Yup, I copied and pasted the list from the site.
As for my case, yes I have an overstay but nothing else. I will be marrying
a US citizen whom I have lived with since I arrived here and my present
attorney has stated that I should have no problems at all and that my case
was reasonably straight forward. I have overstayed 4 years, which worries
me, but he says it will not be a problem as long as I have not worked or
used illegal documents (I have been the male version of a stay-at-home-mom
)
I am good with forms and have already filled out a prelimenary I-130, 325a ,
I-485 and I-765. The only part I am unsure of is on the I-485 where it asks
for application type, I think answer "f" is applicable but not entirely sure
due my attorney in the preliminary answering told me to leave that part
blank.
Thanks for the help
