US Citizen Sponsoring Mother
Please suggest the best and fastest way to get my mother from india on
immigration:
I am a US Citizen interested in sponsoring mother from India. She is
holding expired GC and she visited US last in 1992.My father expired
in May 2003 after being in bed for 12 years. My mother suffered a hip
fracture and no one is there to take care of her in India.Her age is
about 73 years.
Filing of Form I 130 is taking longer time (more than a year) and it
is getting slower as days pass by.This is evident from the processing
times of Nebraska.
Is there any chance that her Form I 130 is processed immediately on
humanitarian grounds.
Is there any chance for success with Returning Resident Visa.

This sounds like a "classic" case for an SB-1 (returning resident) visa,
though 12 years is a little long time ...
However the SB-1 visa is very discretionary. In your case, given
your mother's age and the fact that you are a US citizen, the consul
may be human enough to grant her an SB-1 and spare you from
going thru the whole GC process again.
No harm in trying ....

alien has given up his residence in the United States, it may or may not be
possible to obtain a nonimmigrant visa, depending on whether the applicant
has established a residence abroad to which he will return. If the applicant
wishing to return to the United States cannot submit convincing evidence of
compelling ties abroad he may have to apply for an immigrant visa on the
same basis by which he immigrated originally, if that is possible.

This is a possibility. You would file the I-130, wait until you get the
Receipt Notice, and then ask your Congressperson (call a staff person in the
local office of the Member of the House of Representatives for your
district) for help in getting the I-130 expedited.

I think there is a *chance* -- I'm not sure how great it is, but she will
not know unless she tries.

This is a possibility. You would file the I-130, wait until you get the
Receipt Notice, and then ask your Congressperson (call a staff person in the

district) for help in getting the I-130 expedited.
