Can anyone tell if H1B holder take advantage of 245i? in terms of two cases
1> still under H1B
2> after laid off and out of status

245i does not give anyone any new way of qualifying for immigration.

The provisions of 245i are only *useful* to a person who has violated status.

However, a person who has not violated status can certainly have a person or employer
file the requisite immigrant petition or labor cert application on his behalf. Then,
if the person *later* violates status, the person can take advantage of 245i.

Thanks a lot!

My situation is rather complicated, I worked for company A with H1B and they
sponsored my GC a while ago, but when I was waiting for the approval of I140, I was
laid off last month. However, company A said they are not gonna revoke I140 and my
H1B visa temporarily and they said I can take over the Prioriry Date of that I140.

I am now working for company B under H1B portability law and my H1->H1 transfer is
pending. I guess comapny B won't sponsor my GC until I work for them for 6 months.

Can you give me any suggestions on my case? which one I can talk to ? company A or
company B?

And I have already file my I140 in company A and i was laid off, does that mean I am
automatically qualified for 245i???? (i.e., I have filed LC/I140 before 4/30/2001)
