Hi,
My LC was rejected under Software Enginner category under RIR. We are
about to publish ad for the same under non-RIR (priority date as July
2002). Now my title has changed to Senior Software Engineer, as I am
at begining of the process, I could either start fresh to publish new
ad and loose priority date or take the chance of being left at
disretion of DOL (my responsibilities have not changed though). I
still have lot of time before my VISA expires. My attorney has left
the decision on me, I donot see any benefit of re-running the ad
except that now in the add we can give experience required as 5 years
as against 2 years (because of my salary, DOL didn't accept more than
2 years of experience in the ad). I don't think we can change category
to EB2 from EB3 as the job doesnot require masters (even thought I
have it).
Please advise.
