Don't worry, the way you have planned it is the correct way to do things. Yes, he is allowed to come visit while waiting for the immigrant visa to process. There's no real rule about how often one can visit on the VWP, but remember the more trips back to back, the more he will get questioned at the POE. He should bring proof of his ties to the UK just in case.

DHS computers are getting more data in them all the time. The I-130 will more likely than not show up when beloved arrives on that WT application -- and the admission process IS "discretionary".

Your posting suggests that he need get a police certificate from his home country ONLY if he has spent more than six months there since age 16. This is a common error for some reason -- usually by people whose native language is not English.

actually i understood it the first time HE HE anyways sorry i havent posted.. ive been working alot this week so ive been busy.. i also contacted an immighration lawyer, found a few things out.. im glad i talked to you guys though.. made sure we didnt do something that would later get us in trouble

I've been working! Much of my practice is now litigation [and I want to move it more that way as part of working into retirement in the not so distant future]. I've been engaged in legal warfare on several fronts.
