Travelling outside the US - 5 months left to H1B expiry!!
Hi,
Is it okay to travel outside the US with less than 6 months remaining for H1b expiry (Visa stamp in passport, I-94 and I-797). Planning to file for H1b extension after coming back. I-140 applied and pending.
When I re-enter the US after vacation my visa expiry date will be less than 6 months from the entry date.
Would that be a problem at POE?
Leaving in Aug 2011 for 2 or 3 weeks. Visa expires in Feb 2012.
Appreciate your advice.
Thanks a lot,
Pk

Yes, H-1B is dual-intent and it's still valid so I can't see an issue.
