Traveling on H-1B - Please HELP
Hi,
I am currently on an H-1B visa in USA. I cam to USA in 2002 on F-1
Visa and then my H-1B first got approved in Jan-05. It was then
renewed in Feb - 07.
When I was under my first H-1B (Jan-05 - Dec-07), I went to India for
a trip and also got my H-1B stamped on my passport. The expiry date on
the H-1B stamped on my passport is 12/31/07. The H-1B was stamped on
my passport on 12-04-06 in India.
Then in Feb-07 my employer filed for an extension and it is now
approved till 12/09.
I am planning to travel to Mexico or Europe during the first week of
September.
My question is:
1. If I go to Europe and take the appropriate visiting visas from
Chicago, will be able to enter US without any issues since the H-1B
visa on my passport is stamped till 12/07.
2. If I go to Mexico instead for a vacation, can I also get my H-1B
stamped on my passport again since it is extended till 12/09? I am
planning to visit Cancu. What is the nearest US consulate where I can
get my H-1B stamped?
Thanks a lot for your help.
- Mike.

Yes, as long as you also show the approval notice for the H-1B
approval you are currently working under.

This depends on the individual Consulates. The only ones which have to
accept your application are those in your own country. Many other
Consulates will accept applications though. I'm not sure how long
before the expiry of your current visa you are allowed to apply for a
new one.
