Hi,

I am married to a USC and we are both living in the UAE.

I, UKC, need to go back to finalize somethings. Will be only there a week or so before returning to the UAE.

Can I use the VWP to enter or do I need to apply for a visa based purely on the fact that I am married to a USC?

I don't know your circumstances but I would presume that so long as you have not lived in the US before you can use the VWP. Someone else will no doubt be able to confirm that

What was your status before, in the USA? You said come "back", which means you were in the USA before going to UAE.

As long as you are just paying a short visit to the USA, and not doing any work while you are in the USA, and you qualify to use the VWP, my layman's opinion is that you should be fine.

Don't forget to complete an ESTA online in plenty of time before traveling.

Might not be a bad idea to bring a few docs to show ties to back home (mortgage, rental agreement, etc, etc). Just in case they suspect you'll try and stay and adjust from within the US.

But if they don't ask for it, don't worry about it.

Thanks for the quick response.

I was in the US for six years with a H1B visa.

Unfortunately, I have more ties to the US then anywhere else, although I can show my employment contract (with housing) and car rental agreement. Apart from that there is nothing to show
