travel to non home country for vacation h1b status

Default travel to non home country for vacation h1b status

Hello All:

I was working for company A with a valid H1B stamping until 2008.
I have got a h1b transfer to company B and i have started working from
last 2 months.
Can i travel to another country(not my home country) for vacation and
then come back to USA with the stamping i got for company A.

Yes, you can. You need to have the original notice of approval (I-797) and a valid unexpired visa stamp for your previous employer at a minimum.

Yes, your original visa is still valid. You must show your approval
notice from the new company at the same time as your visa when you
re-enter. Make sure they admit you until the end of your new approval
period.

I did this myself a couple of years ago. Upon my return I was taken to
secondary processing at the POE & they refused to admit me until the
end of my new approval period (I had all the necessary evidence &
documentation), instead admitting me until the end of my Visa stamp
(from company A). Needless to say this was very unnerving as I was
admitted for only 2 months instead of the expected 2+ years.

The next day when I returned to work I immediately contact the company
attorneys who worked directly with the POE to have a new I-94 issued
with the correct date -- they basically had to prove to the POE that
myself & the law were right, the POE was wrong. Fortunately it all
worked out but I will never use tht POE again.

Now I vacation in the US & only travel to my home country. I hope your
experience is more positive!

Is it true that canadian citizens do not need to have an H-1B visa
stamp, but only the approval notice when reentering the U.S?

Thanks for the replies. My trip went fine and my I-94 shows the end of
the new approval
period.
