Default traffic violation and filing N-400

How did you guys answer the question Part 10. D. 16 .Have you EVER been arrested,
cited, or detained by any law enforcement officer (including INS and miltary
officers) for any reason? I'm talking here of traffic violations such as a speeding
ticket or as in my case to "failure to yield right of way" for which I was fined $95
? For which I did not even have to appear in courts? Does "citation" include a
traffic ticket?? Any input would be appreciated. Thanks, Ranjini

You were "cited" and by paying the fine you had pleaded "guilty" -- that is what
happened. "Ranjini" <[email protected]> wrote in message

For that question you would answer "yes" you had been cited - and explain the
circumstances etc.. Onigiri "Onigiri" <[email protected]> wrote in message

Thanks, Onigiri. I don't have a copy of my ticket. The incident happened two years
ago. I'm thinking, maybe, I should get a copy of my driving record, which costs $4.50
from the local dmv?? Or maybe I could just attach another sheet of paper with the
explanation, as the form itself hasn't got much room. I'm just trying to figure how
much importance the INS is going to attach to the incident, as basically, it's the
kind of citation that should not affect naturalization. Thanks in advance, Ranjini

If you weren't free to leave at will, you were detained. The N-400 only asks for an
explanation. I think you should attach the driving record showing it if you have it,
otherwise a simple statement should be enough. This is in the instruction for part 10
regarding being detained and not arrested.

Thanks, mrtravel. I'm off to the dmv to get that driving record. Since I have no
recollection of the exact date of the incident either. Won't hurt to attach a copy to
the application. I called IRS yesterday about getting those tax transcripts. They say
10-15 days. Apart from that, this process is not half as bad as what went before. The
fact that we are not constrained by timelines also helps. Could also be because we
are now the veterans of this forum?!! Thanks once again, Ranjini

Oh boy glad you asked this question Ranjini! Steve got a speeding ticket this past
October, so guess we will need to get a copy of his driving record.

If you had given a cheque for the $95, you'd have written the citation number on it,
perhaps ? The cheque would be sufficient, if you can get it or a copy of it cheaper
and easier than your driving record. Calling insurance agent ( auto ) is another
idea, but then it is best to let sleeping dogs lie, lest it come up and bite you in
increased rates the next time you come up for renewal. Aliens who havent become
citizens yet should collect all the paperwork of their run in with any form of
government bureaucracy ....for some, this could be a lifetime.

I just went ahead and got a copy of my driving record. It was the easiest thing to
do. I walked in and was out of there in 15 mts. I don't recall writing down the
citation number on my cheque. Perhaps not. I somehow did not think that a traffic
ticket would have any bearing on my natz. application. At least, another forumer
reading this thread will learn from my experience. Thanks once again. I do appreciate
your help. Best regards, Ranjini
