For you:

http://www.immigration.gov/graphics/...pplication.htm

For your daughter (the quickest is way for the US citizen stepparent to
sponsor her for the I-130. It would be awhile before you could sponsor
her)... OF course, knowing her age would be helpful here.

That means she would be able to immigrate based on your spouse filing for
her - assuming you have full custody of course.

Does that mean you are not currently legal? More information about your
situation is probably needed. Processing times vary from district to
district, you can find estimates of some of them here:

Hi Andy,
Thanks for your reply. I am legal in US, and our marriage is legal too. But we didn't start yet any paperwork for changing of visa type. I am now on a F-1 visa.
We want to go back to my country this winter and bring my daughter with us. This is why I asked about the time, because we need to know when and if we can buy airplane tickets.
Thx,

Way too soon to be thinking about airline tickets! Research the issues first
and try to estimate timelines. Depending on what part of the country you are
in, the I-130 for your daughter could take a loong time in itself. Being on
F-1 you should be OK to just file so long as you didn't lie about the
relationship (if it then existed) when you applied for the F-1.

Sorry but I don't think there's anyway that you'll be able to get your
daughter here by then. For a *spouse* overseas, the quickest way to get them
here is usually a multi-step process. The I-130 is filed; when the BCIS
sends the notice of action you file an I-129F and when that is approved the
spouse can file for a K-3 visa and, if they have dependents, they can file
for a K-4 visa. Unfortunately, as far as I know, you can only file the
I-129F for the spouse - you can't just file it for the child. That would
mean it would have to be filed for you and you would have to return to your
home country to get a K-3 visa to return to the US with your daughter.

Even though that multi-step process is quicker than waiting for the I-130
for most juristrictions it's still somewhat lengthy.

Start last Christmas? Seriously, what was your original plan before
deciding to get married? You were already in the US on a F-1 visa.
Did you intend to be a student after Christmas?

You should contact the immigrant visa people at the US Embassy in that
country and find out if a non resident (of that country) US citizen can
file I-130 AT THE EMBASSY. This is called DCF (Direct Consular Filing).
For this to happen, the US citizen would have to travel to the Embassy.
This would generally be the fastest way, but could still take months
depending on the country.

If DCF is impossible, there is no way your daughter is going to get an
immigrant visa by Christmas, and there is no way I would recommend her
coming without one.
There are many people on this newsgroup waiting for this process. I am
quite sure they would be happy if the process only took 3 months.
