Tax returns and AOS
My wife has a question, which I'd like to pose to those in the know regarding tax returns.
My wifey is a US citizen, and I'm a Brit. We are married, living together in NY, and filled for AOS in October.
What my wife wants to know is can she claim me as a dependant for the time I've been here when she completes her tax returns in the New Year, bearing in mind I have not got my EAD yet, and therefore, no SSN? Can I get a Individual Taxpayer Identification Number from the IRS by submitting form W7?
We're assuming I can, because the IRS FAQ has a example situation of a Canadian citizen living with a USc doing just that.
Another thing she wants to know is can she claim as head of household as she pays all the rent and utility bills, etc?

Yes you and she can file jointly. You are not a dependent per se but if you file jointly, you are able to use the deductions for 2 people.
As for head of household, no she cannot. If she reads the 1040 form, to be considered a head of household you have to have a dependent child. Sorry about that.
If you read the K-1 FAQ, there is a link to the what is called the Mysterious Brown Envelope. On the left side of that link is an exclusion of how to file your US taxes for that first year.
