Switch to premium processing for I-140?
Hello,
Looks like TSC has updated their Processing Time Information and they are processing I-140's received as of 9/27/2012. Last update that they had before that put the I-140's at 4 months.
So - I am wondering at this point as we are now at 6 months, if it is worth paying for premium processing?
I filed my I140/I485 concurrently and apparently, the processing time for I-140 is currently 4 months. Obviously I485 can not be approved until I140 is approved, so (in theory) I should be able to shave a couple of months off the total approval time by using premium processing?
Just wondered if anyone had any thoughts...

yep...pay the 1000 bucks or so and get the decision in 2 weeks.

If you qualify, it's a no brainer.
I'm currently waiting on a NIW (which does not qualify) and about to hit Month 7 (or 206 days). NSC dates have not moved since December and HB1 visa's start on April 1st.
Wish I had that option!

Has anyone considered whether or not it's even possible to pay for premium processing after the fact... considering that the application has already been submitted?

Apparently you can upgrade at any point during your application. Since I don't qualify, I've not fully researched it.

erm if today is 3/26 and you have been 'in' 6 months doesnt that mean your date was around 9/26 so almost current ? AFAIK you cant PP on EB1C if thats relevant

I'm EE2, so PP is available to me.
When I say 6 months, I mean that is the current TSC processing time for I140's.
I emailed the lawyer today - let's see what he says...

yes you can upgrade to PP after the fact. Although it might take longer than 2 weeks.... alot longer if you already have a nasty RFE delivered.

My own personal experience: I payed for the PP fee at the time my employer filed the I-140 (this is perfectly legal). We received an RFE 12 days after filing, that was straight-forward and we replied to it within 2 weeks. We then received a second RFE within 10 days of submitting the reply! This one was for stuff we had already sent them... They approved the petition 7 days after replying the second RFE. Three weeks later my I-1485 was approved.
There is a lot of talk about PP making RFEs more likely. I don't know if this is true. What is ture is using PP will make things go faster, even the RFEs will be reviewed faster once you send them back, becasue the 15 dya limit applies to RFE responses.
