Surrendering the 1-94?

Hi everybody,

Thanks for all the help along this process! I'm now at the stage of having adjusted
status, and things have gone pretty smoothly.

I will be using my Parole for the first time next week and returning to Canada
briefly. Am I really supposed to surrender my 1-94 when leaving? It has seemed to be
such an important document until now!!!

Yes you surrender it and fill out a brand new one when you come back into the US.
Then you will be able to continue to use that new I-94 for short trips (less than 30
days) to Canada because your status will be the same as on the I-94.

BTW, I heard that the INS are considering abandoning the 30 day rule as part of
tightening the borders. I don't really know why that helps - they still get a chance
to question you when you are re-entering with a valid I-94 (in fact, I got the
toughest questions I have ever had when re-entering from Canada after a two hour trip
to the Canadian side of the Niagara Falls!).

I'm not familiar with the 30 day rule, what is it? (I don't pick up my Parole
document until Monday, maybe that will answer this.)

never heard of the 30 day rule either and I'm married to a Canuck who has traveled back and forth to Canada many times on his Advance Parole.

Andy can you explain this 30 day rule you mentioned.

I believe this is the rule where folk on many types of visas in the US need not
surrender their I-94 at the border for trips into Canada of thirty days or less.

My husband (Canadian) had his I-94 removed the first time he used his AP, and he was
never issued another - but the only foreign travel we did was to Canada. All the
border guards looked at was his AP.

That's the one - it applies for Mexico too and, I believe, some of the
Caribbean islands.

I'm missing something in this discussion.

If you've already adjusted status, why will you be using Advance Parole?

And didn't you already surrender your I-94 at the Adjustment of Status interview?

I submitted my application for adjustment of status a couple weeks ago, pardon me.
