Student worked off campus
Hi there,
My friend is in F1 visa and he has worked off campus for 5 months during
his freshmen year without any prior authorization. Now he's about to
graduate and he is worried that how this is gonna effect if he applies for
the GC through Employment.

Well, tell your fren he is just about to graduate and need not have to
worry about the employmnt based immigrant visa at this time. OPT or
H1-B working visa's will allow him to work legally for another 7
years. During that period of time, your fren can and need to find a
competent lawyer for the "violation" on F1.
this is where a competent an immigration is needed to file for the GC
application.

The worst thing that can happen is that he will not be able to adjust his
status to Permanent Resident in the US but will have to go the consular
route. But that's not something he should worry about now. It's still a long
way off.
For the neart future, if USCIS has a record of him being employed, he may
not be able to change status from F-1 to another visa, such as H-1B in the
US. In that case he will have to apply for a visa abroad.

And I am awared of many cases that got approved. In fact, some of the
students were even caught by immigration department while working at
NY restaurant on F1 before graduation. There is still light at the
end of the tunnel should your fren need to go through the consualr
process abroad.
