Straight I-130 (no k-3/4) questions

Default Straight I-130 (no k-3/4) questions

I am working on a pair of I-130's for my wife and her 17 year old
daughter who will be going through the Moscow Consulate for her
interview. Our 1st NoA date is December 2, 2002 with the NSC so we
are a ways out in terms of time. I am unclear on a couple of things.
Which affidavit of support will be required of me, I-134 or I-864?
Also, I am having a difficult time finding up-to-date information
about the interview process at the Moscow Consulate, including timing,
etc. Do I understand correctly, for example, that unless I pay an
additional fee ($110??) to have the approval cabled to Moscow, it can
take as much as 60-90 days for the approval package to arrive via
diplomatic pouch? If so, when do I pay said fee?

What does the timeline look like beginning with the date of approval
of our I-130 petitions? I greatly appreciate any and all insights,
and no, I don't believe it is necessary to be uncivil in order to
elicit a response from the subscribers to this NG.

Hi:

The approved I-130 are sent from INS to the Department of State "National Visa Center" which is located in Portsmouth, NH. THEY are the ones who do the intial processing!

hi, I didn't do an I-130 - we did an I-129(F), but I did hear about the I-824 form which can be used as a "cable request". Most people say it is not necessary anymore as most service centers automatically cable your documents. But if you decide to use the I-824, send it with the original petition. I think the best thing to do is call your service center to find out if they actually cable requests or not to the country you are working with!

Otherwise, you can actually send your NOA2 by registered mail (but you have to send the ORIGINAL so it's at your own risk!) to the embassy overseas. And, it is nearly certain you will be asked to produce the original I-797 Approval Notice sometime during the Adjustment of Status process - so you may not want to part with it!Since children are not listed on the I-797 Approval Notice as beneficiaries, the Consulate will not schedule an interview if there is a K2 visa involved until the approval package from INS is received by the Consulate. So since their is a child involved I guess you can't do that anyway!

This persons *wife* will not need to adjust status. She will enter the US as a permanent resident. The I-864 is required for this type of visa.

As another poster mentioned, the I-824 filing fee is $140.00. If you want to submit an I-824, I would imagine you should do one for each I-130 and submit them at the same time as the I-130. If you try to submit them later in time, they probably won't help in the case.

All the cable is, is a fax from a Service Center to the Consulate telling them certain things about the beneficiary, so "IF THE CONSULTE IS WILLING", the Consulate will have information it needs to get the first packet on the way (plus open a provisional file, assign a consulate case number, and I'll bet start the background checks). Not all Consulates are willing to do this even when they "do" get a cable. Some are, some aren't.

I look at the I-824 as "insurance" to “compel� the service center to send cable (instead of relying on their good graces to do so), in light of the fact that even if they do send cable (which by the way, can take them up to 30 days to do) the Consulate might not act on the cable.

Oh, if you do send an I-824, you should probably modify it/them as they are not really written in a format where they seem to fit the situation of sending them in at the same time as the petition (I-130).

It used to be all of the Service Centers kept the I-824 with the I-129f (and I assume the I-130's too), so they were processed at the same time if submitted together, however the NSC recently started separating them even when filed together, and I've seen some I-824 processed long after the I-129f (and Elvis) had left the building :-).

MU,

Thanks for the thorough explanation of the I-824 story. Sounds like a
crapshoot to me. The biggest issue is that ANY correspondence with
Russia seems to give a whole new meaning to the term, "snail mail".
My wife lives in a relatively small city in southern Russia and air
mail letters take 2.5-3 WEEKS to arrive. Brother...

far.I am bringing my Russian fiancee
to the US.I am a USC.
1st Noa from NSC...June 6 2002
2nd " " " Oct 15

I waited about 5 weeks,enough time for my documents to reach the US
Embassy
in Moscow. One call on the $1.60 line
confirmed my documents had been recieved.I called once a week for two
more weeks,checking for an interview date,It finally was giving for Jan
29,03.
My girl was sent a packet,that instructed
her to call, and schedual a medical exam
2 weeks a head.The packet also included
forms she had to fill out in English,or have
translated.

She had recieved her criminal certificate,
I think in October.

If all goes well,our time line will read as follows.
4 months at NSC...31/2 months to interview.....then...Visa in a few
days?

Thank you very much for your reply, the information you provided is
very helpful. It does seem like all aspects of this process move in
slow motion - you actually need to use time-lapse photography to
detect ANY MOVEMENT at all sometimes. In this case, I think you must
either be patient to begin with, develop patience, or go zoomy in the
process. Please tell me more about this G7 site. Please provide
particulars, as I am VERY interested. Thanks again,
