Hi all..
I came to the US in Oct/98 on a K1 visa from Canada and my son did not want to come
with me at that time.. BUT.. Now he does.. He is 19 yrs old and has been listed as
one of my children on all the forms.. I am currently waiting to hear from NSC to have
the conditions of my permanent residency removed.. I should know the answer to this
question but am having a mental block and still in shock/wonderment from the
telephone call I just had with him.. What do I do?? Please help as we really want him
down here with us.. AAAARRRRGGGGGGHHHHH!!
Please

You are in luck. You USC wife can petition for her stepson, because you were married
before he was 18 and he is not 21 yet, and it would be an immediate relative
petition. If you were to file as a PR it would be 5-8 years before he would have a
visa issued.
If he can make a "clean entry" into the US, you can use the Tourist Adjustment
section on Doc Steen's site, and file all the paperwork at your local INS office.
http://www.mindspring.com/~docsteen/...o/visainfo.htm - or else your wife would
need to file the I-130 with the Service Center and wait for approval before he could
receive a visa, which could take up to a year before he could enter the US.
Another site which also explains what you need to do is
