One of my relatives was sponsored by his employer fo immigration visa
under Sec 245.
He hired an immigration lawyer. He also included his wife and two
children in the petition.
His application was approved and he already got his green card over a
year ago.
But his wife and childrens' paperwork has not arrived yet. Despite
repeated phone calls to Nebraska Immgration center, Visa center, and
his own attorney, no help in sight yet. His attorney demands another
$1500 to look into his case. Should he pay additional fee for this
case that should have been taken care of already?
Is there a separate approval letter/form that comes from INS for
dependents? The approval letter he received did not have his
dependent's names on it.
We have a feeling his attorney did not include his dependents in the
petition/application at all! Should the attorney be liable for that?
What is his recourse if the attorney goofed and did not include the
dependents in the petition?
