Hello All: Is there a way (other than waiting in line from 2:00am to find the
status of a pending I-140/I-485 application that was filed in person at the San Jose,
CA INS sub-office ? The 800 number doesn't have case info. Also, when the application
was filed in person, an A# was assigned, but, the receipt (cash register) did not
have the usual INS 13-character case tracking number. So, basically, I'm stumped
about how I can find the status of my case. I've already made 1 trip, without any
success. I arrived at 6:00am and waited until 10:15 only to be turned away since the
tokens were used up.

Any help would be greatly appreciated, Thanks, Nitin

Did you mean, an I-130/I-485 (that is, family-based immigration)? I-140s
(employment-based immigration) are not processed in San Jose, and are never filed
together with I-485s.

The reason there is no 13-character case number is that these numbers are used only
by the four service centers. Since you are in California, if you really meant to file
an I-140, you should have mailed it to Laguna Niguel (Laguna Niguel does not accept
walk-in applications), and they would send you a receipt notice.

If you indeed meant to say you filed an I-130/I-485 in San Jose, then don't
bother inquiring about the status for quite a while. Processing times can reach
several years.

Incidentally, the 800 number will not have your case status because they only deal
with naturalization applications. You must call the office where your application is
pending directly to find out the status.

Ingo: Sorry, I did mean I130/I485. They say the I485 takes upto 2 years, but, what
about the I130 itself? I'm asking because we've moved since we filed this application
and have informed INS about our new address. However, other than the return receipt
from the USPS, we haven't received anything from INS confirming our change of
address. So, I was a little concerned about the whole issue. Thanks for your reply.

You won't hear anything from INS until you are notified to have your
fingerprints taken.

Then you will receive a notice of the interview appointment.

I don't think you can confirm your change of address, other than inquiring in person.
If too much time goes by, you can make an inquiry, or ask for the help of your
Congressperson, Zoe Lofgren. She is quite familiar with the problems of INS San Jose.
