If the father is a US citizen living abroad in the mother's country, is the minor
child eligible for US citizenship?

Thanks in advance for any comments.

When and where was the child born? Roughly how much has the father been in the US and
at what ages? (Were the parents married at the time? Don't know if that makes a
difference or not.)

The child was born in the country of his mother. The father is a naturalized US
citizen living in his wife's country.

Thank you for your input.

If the US father was born in the US, lived there for at least 5 years, two of which
were over the age of 14, then any children he has, regardless of where they are born,
are US citizens at birth. If the US father was born in the US, but did not reside
there when he was over 14, or if he was born outside the US and has never resided in
the US or resided there less than 5 years, then his minor children would not be US
citizens at birth. Take Care. Shelley

The above is correct if the father was married to the the mother at the time of the
birth. If the father was not married to the mother then there are some additional
requirements, namely:

1) a blood relationship between the child and the father is established by clear and
convincing evidence;

2) the father had the nationality of the United States at the time of the child's ;

3) the father (unless deceased) agrees in writing to provide financial support for
the child until age 18; AND
4) while the child is under the age of 18 years --

A) child is legitimated under the law of their residence or domicile,
B) father acknowledges paternity of the child in writing under oath, or
C) the paternity of the applicant is established by adjudication court.

Ok! I confess: sometimes I do that too! But here there are a lot of knowledable
people about INS/Immigration/Citizenship matters and I stopped to do it for
quite a while!
