I had a question regarding the 3 years tax returns that are needed when filing the
864. Do they ever really check all of the tax returns with the IRS? I have filed the
past 2 years and was way over the poverty level. I never filed in 1999 so I will only
have the last 2 years available. My question is this....... Can I get copies of the
W2's for that year and just fill out the form and give it to them? Will they actually
check to see if there was tax paid that year? Thanks Ben

Check part 7 of the I-864 affidavit of support under "Concluding Provisions". You may
also want to consider the list of penalties for perjury. It is a very easy procedure
to file back years, especially since you've got the W-2 copy.

Are you willing to risk having your wife's application denied because you didn't file
all your tax forms? You should file one for 1999 now. Take Care. Shelley
