Question about I-94 renewal

My H4 visa was renewed till Oct. 2001 but I did not renew the I-94 which was till April
30, 2000. Is there any need to renew the I-94 even though you do not leave the country.
Could it create any problems during permanent residency process. Any inputs would be
appreciated. thanks flora

Yes, the I-94 must indeed be renewed, and, yes, it can cause a problem. You have been out
of status for almost a year now, and if you leave the country, you would be subject to the
three-year ban (or the 10-year ban after April 30, 2001).
You can still get the GC, thanks to the newly extended 245(i) provision. Here is what you
must keep in mind:
- DO NOT under ANY circumstances leave the US (the only exception is deportation - in that
case, apply for voluntary departure). Not even if a family emergency arises.
- DO hire a competent lawyer. You could probably do it yourself, but a lawyer is generally
a good idea if he knows what he is doing (not all lawyers do!)
- DO file form I-485 when the time comes, together with your spouse. Also attach form
I-485A and an extra $1000 check for the penalty fee.

Ingo I am in the same situation. My I-94 expired in Oct 2000. But I got my renewed H1-B
in Dec 2000. Will this effect me If I send my papers to Washington for stamping. Pls
let me know

Ingo, the bottom portion of H1/H4 approval notice has a new I-94. Doesn't that become your
"renewed" I-94? There's no way to renew an I-94 without leaving the country.

You should be OK. Ingo's reply was for the person who was on H4.
Your renewed H1-B should have a new I-94 right at the bottom of the notice.
You can either get the visa in your passport re-validated by sending to DOS, Washington
D.C. or get it done at the US Consulate/Embassy in your country of origin. JJ

You are right as far as H1-B renewals go. The I-94 at the bottom of the H1 approval
becomes the new I-94. You will need a visa stamp on your passport for travel purposes.
That can be obtained either at DOS, Washington D.C. or at a US Consulate/Embassy in your
country of origin.
I do not know how H4 renewals work and whether they receive a new I-94.
I think Ingo is correct, since the original poster was on H4 and AFAIK H4 don't get
renewed automatically on renewal of the supporting H1 or do they?? Only someone who has
been in this situation will know for sure, please post if you have.
