Question about I-134 and Co-sponsor tax returns...... PLL
Hi all,
First, wish you all a very Happy Holidays beside your love one, although I know many of us will far from those beloved ones, but together in Heart and Spirit..
My question is, My dad is my co-sponsor for the I-134, if he files a Joint Tax return, do i need both of them, i mean Mom and Dad to be the co-sponsor and sign the I-134 or only one i enough.
And also, something that git my pretty confuse. My parents are fom Puerto Rico, and means we dont pay federal taxes. Byt my dad does one federal tax return, which is the 1040PR, but is only for Social Security purposes. and also files one at Puerto Rico. Do he need to present a copy of the federal or the Puerto Rico on he files? Or can be both? He is self-employed thats why we need a tax return from him for the I-134.
Any help will be appreciate it, I am traveling to Puerto Rico today fro Christmas Vacations and want to get that done during this time
Please anyone helpp, or if you dont know at least let me know where I can get the right response for this doubt. I dont want to send the wrongs papers to my husband.
God Bless you all and let Him bring you the best for 2003!
Regards,
Lizzie 1977

In many places, no tax returns are needed for the I-134. It depends on
the consulate.
I know that when filing I-864, you would also include W-2s to show what
part of a joint 1040 was your income.

I've asked this a million times and cant get a straight answer:
If you are using a co sponsor on the I-134, does the co-sponsor have to meet the guideline requirements for your entire household which includes petitioner, kids, beneficiary and co sponsor) OR does the co sponsor just have to meet the requirements for herself and the beneficiary?
Ange starts the clock....

Ange,
As I understand it, the cosponsor has to meet requirements for his/her
family + petitioner + beneficiary. Thus, a married cosponsor w/no kids is
cosponsor + spouse + petitioner + beneficiary.
No one on this NG is shy, so I'm sure they'll correct me if I'm wrong.

Re: Question about I-134 and Co-sponsor tax returns...... PLL
So, if the co-sponsor has no husband and files income taxes alone then she just has to meet the requriement for herself and the beneficiary (fiance)? The petitioner makes enough to support herself and her three kids. Just doesn't quite meet the 125% when you factor in the fiance. But the petitioner and co sponsor live together (they are mother and daughter).... does everyone still follow me?

From my understanding, the petitioner IS NOT included as part of the co-sponsor's household -- unless, of course, that household INCLUDES the petitioner already.
I've cut-and-pasted this directly from the State Dept's (revamped!) FAQ for the I-864 (there's no FAQ for the I-134, unfortunately):
Household size means all those living in the sponsor's house or dependent on the sponsor for support. The household size is:
- The sponsor
- All relatives by blood, marriage or adoption living in the sponsor's household
- All dependents listed on the most recent federal tax forms (IRS 1040), whether or not they live in the sponsor's household.
- Any individuals for whom the sponsor has already signed an I-864 and for whom the contractual obligation still exists
- The applicant (beneficiary) for the visa
- The applicant's (beneficiary's) accompanying dependents
You can check out the I-864 FAQ for yourself by clicking ~HERE~.
Ange, for the situation you're describing -- Petitioner with 3 kids living with the Co-sponsor -- I'm not sure how this applies. It's possible that the household size for both the Petitioner and the Co-sponsor is six:
Petitioner + Co-sponsor + 3 kids + Beneficiary = 6 people
I wonder if it matters who lives with whom -- in other words, does it make a difference if the Co-sponsor lives at the Petitioner's home, or if the Petitioner lives at the Co-sponsor's home. I would think there *would* be a difference, but I don't know. Perhaps someone else here does.

Re: Question about I-134 and Co-sponsor tax returns...... PLL
I'm actually a little confused now...
Because all relatives related by blood would be my mother, for example,. but she files her own tax return. She is her own household. So what gives? Shouldnt it be she plus the beneficiary and that's it?
