Question...
Is it at all possible to apply for a green card when an alien is engaged/married to a
person of the same sex??? Has that possibility ever come up??

Did a search on twmlaw.com (attorney site)for "spouse" and came up with this:
"To be eligible to accompany or follow to join, a few criteria must be met. The
spouse and/or child must meet the statutory definition of "spouse" and/or "child."
This precludes, for example, children who are married, unmarried children over the
age of 21, spouses joined by proxy marriages that have not been consummated, and
homosexual spouses."
They didn't cite the specific rules, but I think I ran across the 'official'
definition somewhere that a marriage is only between a man and woman. Still, INS
recognizes any marriage that is legal in the jurisdiction where it was done. Looks
like we may have to wait for the courts to decide.

I think your first post was correct -- it will take a Legal Test to determine this
one. More and more places are recognizing same-gender unions.
I wonder if there's anybody out there brave enough to try....

This would be a very interesting case. Concidering the fuss they can make about
"moral character". and that is purely a subjective call on the part of the
interviewer.

What I've herad is the INS thinks same-sex is ok but does not count for immigration.
