Default A quamire of a situation.

I was legally admitted under a J-1 visa (with the two year return) but overstayed my visa. I applied for Asylum but was referred to the courts due to late filing. My lawyer advised that I should try "witholdal of removal" instead of Asylum alone since he doesn't see much of a chance in that direction. My question is this:
If I should be granted "witholdal of removal" and I marry my fiancee( who is a natural born US citizen)..would that help me in getting my green card at all ( I don't care if it is 10 years later) and finally end my life as a "stateless" being.? Or is the J-1 going to come back to bite my arse if I should get out of the Asylum proceedings?
