Processing of H1-B without an Attorney???

Default Processing of H1-B without an Attorney???

Is it possible for a H-4 visa holder in the U.S to process an H1-B without an
attorney???What are the necessary documents for the same???

Priya,

It is possible to process a change of status from an H-4 to an H-1B without an
attorney. Whether it is a good idea or not depends on your credentials, the position,
and your ability to prepare the proper forms.

It is difficult to simply provide a checklist of the encessray forms, particluarly
since every state is different for the prevailing wage. Also, the labor condition
application (now completed over the Internet), seesm to change every 3 months.

While possible, make sure you research the proper forms both at INS and the
Department of Labor.

Check http://www.immihelp.com/visas/h1b/re...ChangeOfStatus at first Check INS,
DOL sites for updates

In my case there were ETA9035, then Letter from Employer, I129, I129W, Foreign degree
evaluation, copy of all I94, pasport, check for 1000 from employer, I129 fee.

If you have enough time and your case is clear you can do it yourself. In case of
problem you can refile or amend petition one more time
