Default process for social security number after DCF? anyone?

We are now the new owners of IR-1. on the DS-230 there is a question something like - do you want a SS# to be filed for you. We ticked "yes", but what does this mean? we will be arriving in NY around January, what would then be the process for my husband? would he be able to recieve a salary immediatly upon arrival?

also - does anyone know what the process is for getting citizenship for LPR children? I know they are automatically entitled, but where do we do this? local BCIS office?

Thanks!

Hi there, I got an IR 1 visa through DCF and will be moving in December. If you go here this will explain what happens if you ticked yes on the DS-230.

Good luck with the move.

He would go to the nearest SSA office and complete the form to apply for a social security card. If his name is in the SAVE database as an LPR, then the card will arrive at his address in 7 to 10 days.

would he be able to recieve a salary immediatly upon arrival?
A salary for what? Disability? Or are you asking if he can work immediately upon arrival.

They are? If the children are offspring of one USC parent they are usually US citizens from birth and their birth should be registered with the US Consulate. If they are not, they do not become US citizens unless the US Citizen adopts them formally and/or the alien parent becomes a US citizen and the child is under a certain age.

Hi All,

From what I have read if a child has LPR status and is adopted by U.S.
citizen parent(s) the child can apply for a certificate of citizenship two
years after the adoption is final. Can apply for a passport then too.

8 CFR PART 320

§ 320.2 Who is eligible for citizenship?

a) General. To be eligible for citizenship under section 320 of the Act, a
person must establish that the following conditions have been met after
February 26, 2001:

(1) The child has at least one United States citizen parent (by birth or
naturalization);
(2) The child is under 18 years of age; and
(3) The child is residing in the United States in the legal and physical
custody of the United States citizen parent, pursuant to a lawful admission
for permanent residence.

(b) Additional requirements if child is adopted. If adopted, the child must
meet all of the requirements in paragraph (a) of this section as well as
satisfy the requirements applicable to adopted children under section
101(b)(1) of the Act.

INA: ACT 101 - DEFINITIONS

b) As used in titles I and II-

(1) The term "child" means an unmarried person under twenty-one years of age
who is-

(E) (i) a child adopted while under the age of sixteen years if the child
has been in the legal custody of, and has resided with, the adopting parent
or parents for at least two years: Provided, That no natural parent of any
such adopted child shall thereafter, by virtue of such parentage, be
accorded any right, privilege, or status under this Act...

§ 320.1 What definitions are used in this part?

Legal custody refers to the responsibility for and authority over a child.

(2) In the case of an adopted child, a determination that a U.S. citizen
parent has legal custody will be based on the existence of a final adoption
decree.

File an N-600, "Application for Certificate of Citizenship," after two
years.

I assume an IR-1 is an immigrant visa. If you checked off that you wanted
an SSN on the DS-230 and are age 18 or older, you are supposed to have your
SSN card within three weeks after entry. Will be sent to the same address as
the I-551.

If you card doesn't arrive after three weeks, don't waste your time calling
the SSA 800#. Go into your local office with your birth certificate if
available, passport and I-551 card.

Children under age 18 need to apply at an SSA office after arriving to be
assigned an SSN.

I think if you are not aware of the provisions of the law you should at least add an "to my knowledge/ I think" etc. It is very upsetting when people state things as absolute truths when they are in fact wrong!
Children of US citizens are not always citizens themselves. FYI - the US citizen has to have been in the US for at least 5 years, 2 of which have to be after the age 14. If they are LPR's, however, they are entitled automatically to citizenship. I was merely trying to inquire about the process, I didn't ask to verify my knowledge!

As you can also see from the other replies, you were also giving me wrong information regarding the SS#. Again - it would be nice if you added something to the effect that this is what you THINK should be done.

Hehhehehehe, Rete's used to her 'advice' being taken as gospel. Burn!!! Her and resident lawyers often 'have words' with each other about it
