Yes use the same law firm for I-526 and I-829. I recommend lawyer and lawyer based out of San Francisco. I invested in a RC called eb5capital there. They are building a hotel in sanjose. I was one of the first investors. Did my due diligence. Project looks good. Just submitted my I-526 recently.

I do see a scenario where I can exit this project at a much better price. Part of that scenario requires a higher occupancy rate. But we are not there today.

How long is the approval for 526 taking currently?

You can view current time for 526 approval at the official USCIS site here:

Click on the California service centre times(the centre that processes 526 petitions) and then look for 526 in the table. It currently states March 16th, 2012 and this data was posted on April 3rd, 2013 and reflects data current as of Feb 28th, 2012. Generally it is stated that approvals can take anywhere from 8-12 months currently but USCIS is trying to get this time down to a couple of months by hiring more staff and moving to a dedicated office in DC. This move is scheduled to happen in june/july of this year.

So they are only still processing applications from april 2012. Which means they are 1 year behind. So potentially any approval could take about 12 to 24 months. Thats a long time.

I guess it will be a lengthy process. You may have to check with your attorney. So you are waiting for I-829 or I-526?

This will depend almost entirely on the project/regional center. We invested in Jay Peak and our I-526 was approved within 4 months and our I-829 recently within 2 months.
As regards the financial risk, well it is wait and see. In the end one is investing in a brand new enterprise and you cannot expect that you will get your money back in a short time frame: too hard to re-finance and too hard to re-sell the property without financial history.
